Terms and Conditions

It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Copyright

The copyright of all images created by the photographer is fully owned and retained by Susan Alexander at all times. Any images or copies of images whether stored digitally or otherwise and any computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means without the permission of The Photographer in writing.

Photographers Promotional Use

Susan Alexander will at all times retain the right to use the images created for the purpose of promoting and advertising her work.

Negatives/Digital Files

Negatives / digital files remain the property of Susan Alexander.

Retouching

All images will under go basic digital adjustments to colour balance and crops. Specific retouching, digital manipulation and artistic finishing is also available to the Client as an optional extra.

Images

All image sizes are nominal, different sizes may mean adjusting the crop. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching/likeness. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye. In accordance with the accepted practises of all professional photographers and photographic laboratories, the return of any technically acceptable photographs or prints cannot be entertained on principle. No exception whatsoever can be made to this rule as we cannot be held responsible for individual tastes or exceptions.

Payments

For all non-account clients payment in full is due once the shoot has been completed and the photographs have been ordered. No photographs will be delivered until all payments due have been paid. Payment for additional images is to be made when they are ordered. For authorised account holders payment should be made within 14 days of the date of the invoice. The photographer reserves the right to retain all of the clients materials in his possession until all monies owed to the photographer have been paid in full.

Cancellation

Once Susan Alexander has been commissioned, the client is responsible for payment of all expenses incurred up to the time of cancellation and the photographer will be entitled to charge a fee at her discretion.

Delivery of Products and Services

Disputes over damages, non-delivery or missing goods will not be considered unless notified in writing within seven days of delivery. The photographer will not be responsible for late deliveries due to reasons beyond her control including postage/courier/lab delays, loss of damage in transit.

Licence

The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the willingness of subjects it may not be possible to capture all the images requested.

Attendance

In the unlikely event of the assigned Photographer being unable to attend the shoot due to unforeseen circumstances, we reserve the right to appoint another photographer to attend the shoot on our behalf to undertake the photography to his/her best ability.

Limitation of Liability

In the event of a camera failure, operator error, material failure, or process machine failure the photographer can accept no responsibility for any indirect or consequential loss as a result of any such failure beyond a full refund of the original purchase price.
